中国仲裁法学研究会
中国仲裁法学研究会是在中国法学会、司法部和最高人民法院的大力支持下,由中国国际经济贸易仲裁委员会、中国海事仲裁委员会以及全国30家大中城市的国内仲裁委员会于2004年发起并成立的唯一一家经民政部登记注册的全国性仲裁法学学术团体,现由业务主管部门中国国际贸易促进委员会直接管理。
学会成立之初,本着将全国的仲裁机构、科研院校、仲裁人员紧密地团结起来,共同研究探讨中国特色的仲裁理论、健全中国特色的仲裁制度、建立中国特色社会主义仲裁事业的初衷,受到了全国各地仲裁机构、各大高等法学院校及科研单位的重视、关注与积极参与。
学会成立十多年来,积极开展对外交流活动,增强中国在国际仲裁界的参与意识和话语权 ;组织专家、从业者对多套仲裁规则进行多次修改,使之更接近甚至领先于国际规则。在中国法学会、中国贸促会的正确领导下,中国仲裁法学研究会坚持中国特色社会主义理论指导,创立践行中国特色社会主义仲裁理论,推出了一大批优秀的科研成果,扶植了一大批既通理论又懂实践的专门人才,为促进仲裁学术繁荣、推动国内仲裁事业发展做出了贡献。
目前,中国仲裁法学研究会拥有的团体会员,包括中国国际经济贸易仲裁委员会、中国海事仲裁委员会、北上广深等60多个大中城市的仲裁机构,中国石化和国家能源集团等企业,大成、中伦、君合等律师事务所, 对外经济贸易大学法学院等法律院系,等等。学会有个人会员近千人,涵盖仲裁从业者、大学和研究机构人员、律师、企业法务代表、国内外专家学者等,是代表整个中国仲裁行业水平的学术领军团体。中国仲裁法学研究会的主要职责是 :举行国内外学术研究及交流、培训仲裁员及律师、举办国内外仲裁理论及实务研讨会、出版学术期刊《商事仲裁与调解》及相关书籍等。学会将紧紧围绕依法治国的发展战略,促进中国的经济发展、完善中国的仲裁法律制度、建立有中国特色社会主义仲裁理论、使中国特色社会主义仲裁事业欣欣向荣,走向世界。
中国仲裁法学研究会设立了国际顾问和观察员委员会,以吸纳支持中国仲裁的外籍专业人士。
分支机构
中国仲裁法学研究会已在有条件的高校、仲裁机构和律师事务所批准设立了十多家专业委员会 :
1.海事仲裁专业委员会
海事仲裁专业委员会由上海海事大学申请成立,于2017年6月20日在上海举办了海事仲裁专业委员会揭牌仪式。
2.仲裁规则研究专业委员会
仲裁规则研究专业委员会由西北政法大学仲裁法研究咨询中心申请成立,于2017年6月24日举行揭牌仪式。
3.投资仲裁专业委员会
投资仲裁专业委员会由廊坊仲裁委员会申请成立。2017年6月30日,中国仲裁法学研究会投资仲裁专业委员会揭牌仪式在京津冀(廊坊)协同创新创业基地成功举行。
4.房地产仲裁研究专业委员会
房地产仲裁研究专业委员会由北京金诚同达(上海) 律师事务所申请成立。2017年7月2日,中国仲裁法学研究会房地产仲裁研究专业委员会举行揭牌仪式。
5.金融仲裁专业委员会
金融仲裁专业委员会由呼和浩特金融仲裁院、包头金融仲裁院、鄂尔多斯金融仲裁院、乌海金融仲裁院联名申请成立。2017年7月7日,由中国仲裁法学研究会金融仲裁专业委员会主办的首届中国金融仲裁论坛在呼和浩特市举行,论坛期间举办了中国仲裁法学研究会金融仲裁专业委员会揭牌仪式。
6.仲裁与调解专业委员会
仲裁与调解专业委员会由常州大学史良法学院申请成立,2017年7月14日中国仲裁法学研究会仲裁与调解专业委员会举行揭牌仪式。
7.中等城市仲裁机构发展研究专业委员会
中等城市仲裁机构发展研究专业委员会由安阳仲裁委员会申请成立。2017年10月26日,中国仲裁法学研究会中等城市仲裁机构发展研究专业委员会举行揭牌仪式。
8.中立专家调解与诉讼结合专业委员会
中立专家调解与诉讼结合专业委员会由河北经贸大学法学院申请成立,于2017年10月31日正式成立。
9.知识产权仲裁理论研究专业委员会
知识产权仲裁理论研究专业委员会由北京师范大学法学院申请成立。2017年11月5日,中国仲裁法学研究会知识产权仲裁理论研究专业委员会揭牌仪式在北京师范大学成功举办。
10.亚太仲裁研究专业委员会
亚太仲裁研究专业委员会由中国人民大学亚太法学研究院申请成立,于2018年1月9日举行揭牌仪式。
11. 东北亚仲裁研究专业委员会
东北亚仲裁研究专业委员会由哈尔滨仲裁委员会申请成立,于2018年7月27日举行揭牌仪式。
12. 调解与谈判专业委员会
调解与谈判专业委员会由湘潭大学申请成立,于2018年9月12日举行揭牌仪式。

CHINA ACADEMY OF ARBITRATION LAW
China Academy of Arbitration Law, shortened as CAAL, is a national arbitrational academic union initiated and established by CIETAC, CMAC, and more than 30 arbitration institutions of large and medium size cities in 2004 with the great support of China Law Society and Ministry of Justice and the Supreme People's Court of PRC. Now it is directly managed by CCPIT.
In line with the principle of uniting the arbitration institutions, research institutions and arbitrators together so as to study the arbitration theory with Chinese characteristics, perfect the arbitration system with Chinese characteristics, and establish the socialist arbitration with Chinese characteristics, CAAL draws the attention of arbitration institutions and major highlyranked law schools and research institutes.
In these over 10 years since its founding, CAAL has actively carried out foreign exchange activities, and enhanced China's leading voice and awareness of participation in the international arbitration community. CAAL also organized experts and practitioners to amend many sets of arbitration rules to bring them closer to or even ahead of international rules. Under the correct leadership of the China Law Society and the CCPIT, CAAL adheres to the theoretical guidance of socialism with Chinese characteristics, and establishes
the theory of socialist arbitration with Chinese characteristics, and launches a large number of outstanding scientific research achievements and fosters a large number of both theoretical and practical specialized personnel. In promoting the academic prosperity of arbitration, and the development of domestic arbitration, CAAL has made its contribution.
At present, CAAL has the following members:
● More than sixty Chinese arbitration commissions, like CIETAC and China Maritime Arbitration Commission; Important municipal arbitration commissions at Beijing, Shanghai, Tianjin, Wuhan, Xi’an, Chongqing, Chengdu, Guangzhou, Harbin, Nanjing, and Shenyang;
● Enterprises like Sinopec Group and CHNENERGY (the largest coal supplier in the world);
● Law firms like Dacheng Dentons, Zhong Lun Law Firm, and Junhe LLP;
● Law schools like the Law School of University of International Business and Economy and others;
● About 1000 outstanding individuals from arbitration institutions, law firms, judges in-house counsels of enterprises, teachers in universities, and independent arbitrators all over China.
The tasks of CAAL are to run and organize research on arbitration theory and practice, to conduct training programs on arbitration, and to conduct international exchanges and co-operations. The academic journal managed by CAAL is Commercial Arbitration and Mediation. CAAL had set up the International Advisors and Observers Committee to accept international participants who are interested in and participate in Chinese
arbitration.
Branches
CAAL has established over ten sub-committees supported by local institutions inclusive of universities, arbitration organizations, and law firms all over China:
I. Sub-committee on Maritime Arbitration, set up on 20 June 2017, which was supported by the Law School of Shanghai Maritime University.
II. Sub-committee on Rules of Arbitration, set up on 24 June 2017, supported by Centre of Consultation and Research of Arbitration of Northwest University of Political Science and Law.
III. Sub-committee on Investment Arbitration, set up on 30 June 2017, supported by Langfang Arbitration Commission.
IV. Sub-committee on Real Estate and Housing, set up on 2 July 2017, supported by Jincheng Tongda Law Firm.
V. Sub-committee on Financial Arbitration, jointly supported by Hohhot Financial Arbitration Institution, Baotou Financial Arbitration Institution, Erduosi Financial Arbitration Institution, and Wuhai Financial Arbitration Institution. On 7 July 2017, the first China Financial Arbitration Forum hosted by the Financial Arbitration Professional Committee of CAAL was held in Hohhot. During the forum, the inauguration ceremony was held.
VI. Sub-committee on Mediation and Arbitration, set up on 14 July 2017, supported by Shiliang Law School of Changzhou University.
VII. Sub-committee on Medium City Development, set up on 26 October 2017, supported by Anyang Arbitration Commission.
VIII. Sub-committee on Neutral Expert Mediation and Litigation, set up on 31 October 2017, supported by Hebei University of Economics.
IX. Sub-committee on Intellectual Property Right Arbitration Theory, set up on 5 November 2017, supported by Beijing Normal University.
X. Sub-committee on Asia Pacific Arbitration Research, set up on 9 January 2018, supported by Asia Pacific Law Institute of Renmin University of China.
XI. Sub-committee on North-east Asia Arbitration Research, set up on 27 July 2018, supported by Harbin Arbitration Commission.
XII. Sub-committee on Mediation and Negotiation of Arbitration Law, set up on 12 September 2018, supported by Xiangtan University.
